Oake Law Office, PLLC was founded in 1988 and specializes in patent and intellectual property strategy and litigation. The firm represents patent owners whose patents are being infringed and also those who believe they are being wrongly accused of patent infringement. Our experience and expertise includes representation on related matters as well, such as trademark, trade dress and trade secret law, and unfair trade practices. Our practice includes successfully representing litigants and applicants appearing before district courts, appellate courts, the United States Patent and Trademark Office, and the Trademark Trial and Appeal Board. Oake Law Office created and maintains the Design Patent Pro (DPP) ProSearch database that provides practitioners and researchers the ability to search though selected design patent prosecution histories.

Robert G. Oake, Jr. is a Registered Patent Attorney and is Triple Board Certified in Patent Litigation, Civil Trial Law, and Civil Practice Advocacy by the National Board of Trial Advocacy. He holds two LL.M (Master of Law) Degrees, including an LL.M in Patent and Intellectual Property Law (with highest honors) from the George Washington University Law School in Washington, D.C. Robert served as lead trial and appellate counsel for Egyptian Goddess, Inc. in what has been called the most important design patent case in the last one hundred years. (Egyptian Goddess v. Swisa). He has tried to verdict as lead counsel cases involving design patents, utility patents, and trademarks, and has argued eleven cases before the Federal Circuit Court of Appeals including an en banc case involving a design patent. Robert currently serves as one of four members on the Patent Litigation Specialty Program Commission of the National Board of Trial Advocacy.

Lead counsel for the Automotive Body Parts Association in a series of cases challenging the validity and enforceability of design patents on automotive body repair parts. One of the cases is the first successful use of contested associational standing in a patent case in the United States.

Lead counsel for Egyptian Goddess in a landmark en banc appeal where the Federal Circuit abandoned the “point of novelty” design patent infringement test in favor of principles grounded in United States Supreme Court precedent.

Lead counsel for Skyline USA, Inc. in a series of cases that successfully protected and enforced a core company design patent and led to a consent judgment and permanent injunction.

Lead counsel for numerous other companies in efforts to enforce design patents, defend against infringement, and strengthen design patent protection through innovative prosecution and litigation strategies.

In addition to his law practice, Robert serves as founder and past president of Allen Gifted, a parent advocacy group for identified gifted and talented students in the Allen Independent School District. Robert was named the Outstanding Parent of the Gifted for 2011 in Region 10 by the Texas Association for the Gifted and Talented.
